    Informazioni

The International Court of Justice operates as the primary judicial body for the United Nations, resolving legal disputes between sovereign states and issuing advisory opinions on international law questions. Based in The Hague, Netherlands, the Court functions independently from the UN Secretariat while remaining an integral part of the global organization. Its authority derives from the voluntary consent of states to accept its jurisdiction, a mechanism that distinguishes it from national supreme courts which possess compulsory appellate power over lower domestic tribunals.

Seventy-three nations have declared acceptance of the Court's compulsory jurisdiction under the optional clause as of 2026, though many attach reservations limiting specific applications. The Court handles cases ranging from territorial boundaries and maritime rights to state responsibility and genocide allegations. Unlike other international tribunals focusing on individual criminal liability, the ICJ adjudicates matters strictly between states, making it the central forum for peaceful dispute resolution in the modern era.

    Missione

The Court fulfills two distinct mandates within the UN system. It settles contentious cases submitted by states through binding judgments grounded in international law, offering a non-violent alternative to armed conflict. Additionally, it provides non-binding advisory opinions on legal questions referred by authorized UN organs and specialized agencies, thereby clarifying and developing international legal norms without direct enforcement powers.

    Storia

The ICJ traces its lineage to the Permanent Court of International Justice established by the League of Nations in 1920. Bernard C. J. Loder served as its first President when it held its inaugural sitting at the Peace Palace on February 15, 1922. Over two decades, the PCIJ issued more than 30 decisions and nearly as many advisory opinions before dissolving with the onset of World War II.

When the United Nations was founded in 1945, the new Charter included the statute of the ICJ as an integral part. Judges were elected on February 5, 1946, and the Court officially succeeded the PCIJ on April 18, 1946. Since then, it has handled over 170 contentious cases and issued more than 30 advisory opinions. Landmark rulings include the Corfu Channel case in 1949, the Nicaragua v. United States decision in 1986 regarding state responsibility, and the 1996 Advisory Opinion on the Legality of the Threat or Use of Nuclear Weapons.
